Bluestar Refreshment Services is facing a proposed class action lawsuit that claims it provided prospective employees an unlawful background check disclosure form and miscalculated overtime wages.
Bluestar Refreshment Services is facing a proposed class action lawsuit that claims it provided prospective employees an unlawful background check disclosure form and miscalculated overtime wages. The plaintiff in the case says that when he was hired in April 2014, the defendant provided him a background check disclosure form that contained a liability waiver in violation of the Fair Credit Reporting Act, which the suit says requires that disclosure forms be presented as standalone forms.
The plaintiff further argues that the defendant unlawfully failed to include “PSP” payments in its overtime wage calculations when he worked more than 40 hours per week or eight hours per day.
