A blind individual has filed suit against Dylan’s Candybar, LLC over allegations that its website is not compatible with screen-reading software and therefore discriminates against the blind population in violation of the Americans with Disabilities Act.
A blind individual has filed suit against Dylan’s Candybar, LLC over allegations that its website – www.Dylanscandybar.com – is not compatible with screen-reading software and therefore discriminates against the blind population in violation of the Americans with Disabilities Act (ADA). The site, according to the complaint, is “heavily integrated” with the defendant’s physical stores and serves “as a gateway” to the goods and services the company offers. The suit argues that the website’s lack of alternative text and empty/redundant links hinder blind users from being able to access its content. As a result, they are unable to find information about store locations and hours, sales/discounts, in-store events, and return policies, the suit argues, adding that the plaintiff was unable to purchase items and gift cards or make reservations at a store café due to these access barriers.
