A former employee has filed a proposed class action against Bay Bays Chicken & Waffles (as well as Bay Bays Chicken and Waffles Number Two LLC and its owner).
A former employee has filed a proposed class action against Bay Bays Chicken & Waffles (as well as Bay Bays Chicken and Waffles Number Two LLC and its owner) over alleged violations of the Fair Labor Standards Act (FLSA). According to the case, the plaintiff and similarly situated employees worked around 48 hours per week (which jumped to between 68 and 71 hours per week in 2016) without being paid at the time-and-a-half hourly overtime rate as laid out by the FLSA. The plaintiff says he was paid at four different hourly rates, but never at the time-and-a-half overtime rate. Additionally, the plaintiff claims that when no customers were in the restaurant, the defendants would require him to clock out and then clock back in once customers eventually arrived.
