Bank of America Corporation is accused of failing to pay a former manager properly for on-duty break periods in a proposed class action recently removed from state to federal court in California.
The plaintiff, a former operations manager, claims he was deprived of uninterrupted meal and rest periods because he was required to remain on the premises during unpaid breaks. Under the California Labor Code, breaks should be on-the-clock if employees can’t leave the worksite, even if they are relieved of all duties during this time, the case explains. The plaintiff’s on-the-premises breaks should have been classified as on-duty periods, the lawsuit argues, adding that he was also entitled to premium pay for missed and shortened breaks.
