Florida’s Bal Harbour Tower Condominium Association is the defendant in a proposed class action that alleges it failed to properly compensate employees working in its restaurant. The lawsuit claims the plaintiff was not paid proper time-and-a-half overtime wages for different work periods over the course of his employment, which lasted more than 10 years.
During the “low season” (February through September), the plaintiff claims he worked 50 hours per week without overtime. For the high season (October through January), the plaintiff says he worked 62 hours per week without overtime. For the last three weeks of December alone, the man worked 85 hours per week with no overtime compensation. According to the case, the plaintiff and proposed class members were paid on a per-shift basis that did not account for overtime.
