A proposed class action claims Bab Café LLC, which does business as Jolie’s NYC, and its owner violated state and federal labor laws by failing to pay employees proper minimum, overtime and spread-of-hours wages. The two named plaintiffs behind the lawsuit claim the defendants fell on the wrong side of the Fair Labor Standards Act (FLSA) by not paying proposed class members proper time-and-a-half overtime wages for all hours worked over 40 in a week, as well as spread-of-hours premiums for shifts that lasted longer than 10 hours in a day.
