A class action filed on behalf of current and former bartenders and waitstaff claims Azur Beach Club in Southern Florida failed to pay proper minimum wages under the Fair Labor Standards Act (FLSA). The lawsuit claims the defendant’s policy of requiring serving staff to pool their tips with managers who do not regularly receive tips is a violation of state and federal labor law. Specifically, it’s alleged the defendant unlawfully took a tip credit of $3.02 per hour from servers’ wages while requiring the employees to tip out to managers and bussers, with the proposed class’ pay coming from a thereby diminished tip pool.
