K & C Enterprise Group LLC, which does business as 656 Sports Bar in Atlanta, and an individual owner are facing a proposed collective action filed by a former employee who claims they failed to pay her proper wages. According to the suit, the plaintiff was employed as a bartender for the defendants and regularly worked between 49.5 and 56 hours per week. She says she was not compensated at all for any of the hours she worked, and was paid only in tips she received from customers. The suit alleges that the restaurant’s servers and bartenders were misclassified as independent contractors and are owed minimum and overtime wages that were unjustly withheld from them. According to the complaint, the plaintiff is seeking $25,520 of minimum wages and $12,625.88 of overtime wages that she claims she was never paid, plus liquidated damages and other fees.
