The operating company of Georgia restaurant Malone's and one individual are facing a former server's claims that the parties failed to pay proper minimum wages.
The operating company of Georgia restaurant Malone’s, Atlanta Airport Restaurants, LLC, and one individual are facing a former server’s claims that the parties failed to pay her and similarly situated workers the proper minimum hourly wage. In a proposed collective action, the plaintiff alleges she and proposed collective constituents were required to work off the clock for no pay and, even worse, forced to participate in an illegal tip pool, which together allegedly resulted in servers’ wages falling below the minimum benchmark for tipped employees.
The plaintiff further claims she and other servers were required to attend meetings prior to each shift for which they were not compensated. Similarly, servers were allegedly forced to perform “side work” prior to and after each shift for which they were not properly paid, the case alleges.
