Filed: April 5, 2017 ◆§ 1:17-cv-21291-DPG
Abuelitos Felices II ALF Inc. and two owners are the defendants in a proposed class action filed by a Florida man who claims they failed to pay him required wages.
Abuelitos Felices II ALF Inc. and two owners are the defendants in a proposed class action filed by a Florida man who claims they failed to pay him the required minimum wage and overtime wages. The complaint cites a provision of the Fair Labor Standards Act that details regulations concerning employees’ sleeping periods when they are required to be “on duty” for 24 hours or more, and states under what conditions these periods should count as hours worked. The plaintiff claims he worked for the defendants in their assisted living facility for an average of 105 hours per week, and was paid an average hourly wage of $3.33.
The case seeks to cover employees of Abuelitos Felices who were not paid proper minimum or overtime wages within the past three years.
