A proposed collective action filed in Arizona against the below defendants and two individuals claims current and former home care aids were not paid time-and-a-half overtime wages:
- Fountain Hills Assisted Living, LLC
- Skyline Estate Assisted Living, LLC
- Tuscon Medical Supply, LLC
- Parkers Adult Care, LLC
- Ayse’s Specialized Care, LLC
Filed in Arizona, the lawsuit claims the above defendants violated the Fair Labor Standards Act (FLSA) by failing to pay time-and-a-half hourly wages to home care aids—tasked with myriad in-home caregiver duties—for all hours worked over 40 in a given workweek. The plaintiff, who the case says worked for the defendants full-time from September 2015 until March 2017, says she regularly worked at least two 24-hour shifts each week, in addition to a separate 12-hour shift, without proper overtime compensation.
