A former employee has filed a proposed class action against Aramark Business Center claiming he and other individuals employed as general ledger accountants were unlawfully classified as exempt from overtime pay under the Fair Labor Standards Act (FLSA). Filed in Tennessee, the lawsuit alleges the plaintiff and similarly situated proposed class members regularly worked more than 40 hours per week without being paid at the time-and-a-half hourly overtime rate. Instead, the lawsuit claims, proposed class members were given a salary with no chance of being paid overtime despite having job duties that did not fit the FLSA benchmarks for exempt workers.
