An Illinois drug store has filed suit against an individual who does business as AmpleMedical and AmpleMedical.com, claiming the defendant sent unsolicited fax advertisements that didn’t contain required opt-out notices.
An Illinois drug store has filed suit against an individual who does business as AmpleMedical and AmpleMedical.com, claiming the defendant sent unsolicited fax advertisements that didn’t contain required opt-out notices. The plaintiff insists it never had any prior business relationship with AmpleMedical and never provided consent to receive fax advertisements, yet the defendant supposedly faxed the drug store messages “offering insulin and diabetic test strips and meters.” According to the complaint, the faxes didn’t contain required opt-out notices providing the recipient with “the necessary information to opt-out of future fax transmissions, including a notice that the sender’s failure to comply with the opt-out request will be unlawful.” The case alleges the faxes were sent in violation of the Telephone Consumer Protection Act.
