A class action claims Allegheny Technologies, Strom Engineering owe 'replacement' workers unpaid wages from former's 2015-2016 lockout of its employees.

Two plaintiffs claim Allegheny Technologies, Inc. (ATI) and Strom Engineering Corporation, a company that specializes in staffing for companies embroiled in labor strikes, violated Pennsylvania and Oregon wage and hour laws by failing to pay proper wages to individuals hired as part of a “replacement workforce” during a lockout of the former’s unionized workers. The plaintiffs, who filed the suit in Pennsylvania on behalf of the defendants’ replacement labor force who put in work between August 15, 2015 and March 4, 2016, claim they and other workers—individuals who traveled to facilities and crossed picket lines across the country—were not paid for at least 1.5 to two hours of work time each day, totaling between 10.5 to 14 hours of unpaid worktime each week during the lockout. Much of proposed class members’ unpaid work time involved traveling to work sites, the lawsuit claims.

Two subclasses represented by each plaintiff propose to cover replacement workforce individuals who worked at specific facilities operated by ATI nationwide.
