An employee of Alberto's Construction, LLC has filed a proposed class action in New York against the company and its owner over allegedly unpaid overtime wages.
An employee of Alberto’s Construction, LLC has filed a proposed class action in New York against the company and its owner over allegedly unpaid overtime wages. Citing alleged Fair Labor Standards Act (FLSA) and New York Labor Law abuses, the plaintiff claims he and other hourly masonry and construction workers, within the last six years, routinely worked more than 40 hours per week without being paid at the time-and-a-half hourly for hours worked beyond 40, nor provided with accurate wage statements.
Specifically, the plaintiff claims he worked between 47 and 57 hours each week without proper overtime pay.
