The operating companies of Alaris Health at Cherry Hill and Alaris Health at St. Mary's and the companies' owner are the defendants in a lawsuit alleging FLSA violations.
The operating companies of Alaris Health at Cherry Hill and Alaris Health at St. Mary’s—SCO, Silver Care Operations, LLC and South Center Street Nursing LLC, respectively—and the companies’ owner are on the receiving end of a proposed class and collective action over alleged violations of the Fair Labor Standards Act (FLSA).
The plaintiff worked at the defendants’ Cherry Hill and St. Mary’s nursing and rehabilitation centers as a registered respiratory therapist from October 2013 until December 2016. According to the complaint, the defendants utilized a scheme to evade FLSA and New Jersey state overtime rules by treating each of its facilities as separate and distinct employers. This meant employees’ work hours split between the two facilities were not aggregated by the defendants for the purposes of paying overtime wages.
