According to the 14-page ZuPreem lawsuit, the prominent “natural” claim featured on the product’s packaging is misleading to consumers given that the bird foods contain synthetic ingredients such as pyridoxine hydrochloride, citric acid, folic acid, tocopherols and copper sulfate, among others.
The class action suit contends that reasonable consumers who view the “natural” representation would not expect the items to contain artificial ingredients like tocopherols, a group of chemical preservatives, citric acid, a highly processed additive, or copper sulfate, a manufactured compound registered for use in pesticide products.
“No product labeled ‘natural’ should contain any of these ingredients,” the case charges.
The complaint claims that the companies have “profited enormously” at the expense of health-conscious pet owners willing to pay a premium price for all-natural products, which consumers believe are more nutritious and safer for their pets than items that contain synthetic ingredients.
The plaintiff, a New York resident, bought ZuPreem Natural Bird Food for Medium Birds believing that it was made only with natural ingredients, the filing says. Like other consumers, the woman would not have paid as much for the pet food, or purchased the product at all, had she known it actually contained a litany of artificial ingredients, the suit alleges.
The lawsuit looks to represent anyone in the United States who purchased ZuPreem pet food products marketed as “natural” but that contain synthetic ingredients.
