A New York real estate agency has filed a proposed class action lawsuit against Zillow, claiming the company unfairly charges $7 per day to advertise rentals on its StreetEasy platform even when the listing is not publicly visible.

The 10-page lawsuit alleges Zillow’s failure to maintain realtors’ property listings on StreetEasy while being paid to do so is an illegal breach of contract. According to the case, the defendant has wrongly profited at real estate professionals’ expense and owes proposed class members damages for fees paid to list properties that were removed from public view.
The complaint says StreetEasy—a real estate listing platform for properties in the New York metropolitan area—charges realtors a daily $7 fee to advertise their property, name and contact information.
However, the filing shares, StreetEasy displays only the most recent listing realtor to consumers when multiple agents advertise the same rental. Per the suit, the platform hides or removes from public view any previous listing realtors, all while continuing to charge the prior listing realtors $7 per day for their listings.
“Zillow should not be permitted to retain the payments which include profits realized by [the defendant] by collecting daily fee payments on property listings it failed to display on its StreetEasy online platform,” the filing contends.
The lawsuit looks to represent anyone who, within the applicable statute of limitations period, paid to list a property for sale or rent on Zillow’s StreetEasy platform only to have their listing masked or otherwise removed from public view and was still charged the daily rate after their listing was masked or otherwise removed from public view.
