The 33-page lawsuit says Zenwise does not disclose anywhere on product packaging or in marketing materials that its gas and bloating relief supplements “cannot do what [Zenwise] claims they can do.” The probiotics and digestive enzymes in the Zenwise supplements at issue have been shown through research to be ineffective at combatting gas and bloating, especially at the dosages at which they exist in the products, the suit contests.
In particular, though the Zenwise products are touted as fast-acting and “clinically proven [to] work in hours,” an expert physician retained by the plaintiff’s counsel reviewed the published scientific literature regarding the supplements’ primary ingredients and opined that the enzyme blend included in the products “is not potent enough to provide relief for gas and bloating when taken as directed,” the case states. Per the complaint, studies measuring the effect of the enzyme α-galactosidase have shown it to have “no statistically significant results” as far as quickly relieving gas and bloating, even though the dosage in the studies was at least four times that found in the Zenwise supplements.
Further, the medical expert concluded that the Zenwise products cannot be “clinically proven” to provide gas and bloating relief within hours because studies conducted on DE111, a probiotic in the supplements, found that it was unable to have the desired effects, the filing adds.
According to the lawsuit, Zenwise’s gas and bloating relief products exist amid a cottage industry offering over-the-counter solutions to the common ailments of gas and bloating. Such products have been highly lucrative, as the majority of consumers seek over-the-counter remedies for gas and bloating rather than physician care in a formal setting, the suit shares.
“With knowledge that a general population of vulnerable consumers suffer from debilitating gas and bloating issues, Defendant has deployed a sophisticated, uniform marketing campaign for the Products, including on Amazon and on social media platforms such as TikTok. This false advertising scheme has worked. The Company has lined its pockets with tens of millions of dollars in ill-gotten gains from consumers.”
The plaintiff’s medical expert also opined that it is “highly deceptive” to suggest that probiotics work within hours because “it has not been shown, nor is it true, that [the probiotic in the products] works within hours to provide relief,” the case reads.
Overall, the medical expert said that Zenwise’s “no bloat” and “banish bloating” relief claims are “scientifically impossible” as there is no known product or ingredient in the scientific literature that has been shown to completely reduce bloating in consumers who suffer these symptoms, the complaint goes on.
“In sum, the expert’s findings were that Defendant’s claims that its Products would provide fast relief for gas and bloating were neither clinically proven, nor were the Products capable of providing the promised results at the dosages Defendant recommends. Therefore, the expert concluded that all of the claims discussed are false and deceptive.”
Neither the plaintiff nor other consumers would have bought Zenwise gas and bloating relief supplements had they known the “worthless” products are not in fact clinically proven to provide the promised results and are incapable of providing the results if taken as directed, the case argues.
The Zenwise lawsuit looks to cover all persons in the United States who bought Zenwise’s Digestive Enzymes and/or No Bloat supplements.
