The 13-page Yummy Dino Buddies lawsuit says that despite the products’ labeling, which represents that the supposedly “100% All Natural” chicken nuggets are made with “No Artificial Ingredients,” the items contain synthetic additives, including soy protein isolate and xanthan gum.
The class action suit challenges the all-natural labeling claims of Yummy Original Dinosaur-Shaped Chicken Breast Nuggets, Yummy Alphabet-Shaped Letter-Shaped Chicken Breast Nuggets, Yummy Whole Grain Dinosaur-Shaped Chicken Breast Nuggets, Yummy Gluten Free Dinosaur-Shaped Chicken Breast Nuggets and Yummy Gluten Free Chicken Breast Fries.
The case contends that based on the representations, reasonable consumers would not expect the products to contain artificial ingredients such as xanthan gum, a thickening agent, and soy protein isolate, a highly processed substance used in foods as an emulsifier and a means to improve texture, retain moisture and increase protein content.
According to the complaint, the manufacturer has misrepresented its line of chicken nuggets in a bid to capitalize on increasing demand from health-conscious shoppers for natural food products that are free of synthetic additives.
Consumers would not have paid as much for Yummy Dino Buddies chicken nuggets, or bought them at all, had they known the items were misleadingly marketed as all natural, the filing claims.
The lawsuit looks to represent anyone in the United States who purchased the products for personal or household consumption, and not for resale, during the applicable statute of limitations period.
