York Risk Services Group, Inc. is facing claims that the insurance claims adjustment firm sends unlawful, automated text messages to consumers it believes are Lyft drivers even after they revoke their consent to receive the texts.

York Risk Services Group, Inc. is on the receiving end of a proposed class action recently removed to Illinois federal court. The lawsuit alleges the insurance claims adjustment firm sends unlawful, automated text messages to consumers it believes are Lyft drivers even after they revoke their consent to receive the texts.
York, according to the lawsuit, contracts with ride-sharing service Lyft, Inc. to provide insurance claims adjustment services to Lyft drivers. The plaintiff in the case, however, claims that York frequently sends automated text messages to drivers after they’ve requested that the texts cease, in potential violation of the Telephone Consumer Protection Act (TCPA).
The plaintiff alleges that on August 29, 2018, the defendant sent him two automated text messages regarding an incident report, to which he responded “Stop” and “No more texts.” Despite the man’s requests, York, the case says, sent him two more automated texts in November 2018 without his permission.
“In addition to being a nuisance and an invasion of privacy,” the complaint reads, “Defendant’s unauthorized automated text messages consistently interfered with Plaintiff’s, and Class members’, use of their cellular telephones.”
