The 10-page lawsuit was filed by a man who claims to have received at least eight unwanted phone solicitations from the business review platform within less than two weeks this summer. According to the case, the man had never used Yelp’s services, never consented or requested in any way to receive calls from the company and had been listed on the National Do Not Call Registry for nearly three years.
As such, the complaint accuses Yelp of violating the Telephone Consumer Protection Act, a federal law that prohibits the initiation of telephone solicitations to individuals who have placed their number on the National Do Not Call Registry.
Federal regulations related to telemarketing state that do-not-call registrations “must be honored indefinitely, or until the registration is cancelled by the consumer or the telephone number is removed by the database administrator,” the filing relays.
The plaintiff claims that his privacy has been violated by Yelp’s unsolicited calls, which, according to the suit, were likely placed en masse to thousands or even millions of customers. Per the case, recipients have been annoyed and harassed by the calls, which “occupied their telephone lines, storage space, and bandwidth, rendering them unavailable for legitimate communication, including while driving, working, and performing other critical tasks.”
The Yelp lawsuit looks to represent anyone in the United States whose telephone number was on the National Do Not Call Registry for at least 31 days but who, within the past four years, received more than one telemarketing call from or on behalf of the company within a 12-month period.
