A proposed class action lawsuit alleging violations of the Fair Credit Reporting Act of 1970 (FCRA) has been filed against World Class Installations, Inc. The complaint, filed in Florida, claims the electronic locksmith company unlawfully took adverse employment action based on information contained within consumer reports, i.e. background checks, without first making proper mandatory disclosures to the plaintiff and proposed class members. The complaint says the defendant failed to provide proposed class members with a copy of the pertinent consumer report and with a reasonable opportunity to respond to the information in said report before taking adverse employment action, which generally includes termination, demotion, or reduction of hours.
In addition to relying on third-party background checks—called “consumer reports” within the FCRA—as part of its screening process for prospective employees, World Class Installations also conducts checks on its current employees “from time to time,” the lawsuit says. The plaintiff alleges that he was hired by the defendant in December 2016 and quickly fired based on information the company obtained through a background check. The man claims he was never notified of his rights under the FCRA, never provided with a copy of the report, and never given a chance to respond.
