Silverman v. Move, Inc. et al
Filed: September 17, 2018 ◆§ 0:18cv62189
Move, Inc. and the National Association of Realtors are facing a proposed class action claiming the defendants sent hundreds of unsolicited texts to a consumer.
Florida
Move, Inc. and the National Association of Realtors are facing a proposed class action claiming the defendants violated the Telephone Consumer Protection Act (TCPA) by sending hundreds of text messages to a Florida consumer without her prior express consent.
The case alleges the defendants—who collectively own and operate website Realtor.com—began sending texts to the plaintiff in early 2018 promoting local real estate leads listed on the site. Following the defendants’ designated opt-out response, the complaint continues, the plaintiff texted back “stop,” effectively revoking her consent to receive further advertisements. The defendants, however, went on to send the woman over 200 automated texts without her permission to do so, in violation of the TCPA, the suit says.
The complaint charges the defendants "engaged in systematic text-message-advertising campaigns, without regard for the law or the privacy rights of others."
