Merchants & Professional Credit Bureau, Inc. has been named as the defendant in a proposed class action filed by a woman who claims the debt collector falsely threatened her with litigation when it had no intention of actually suing her. According to the complaint, the plaintiff received a collection letter from the defendant regarding an alleged medical debt. The notice reportedly informed her she had “one more opportunity to make payment in full” and warned that she must pay within 72 hours or face “further collection action.” The case claims these statements were “threatening and harassing,” meant only to induce the plaintiff into sending payment in the hope of avoiding a lawsuit. Further, the complaint alleges the defendant never intended to file suit against the woman after 72 hours, meaning its statements were effectively false threats prohibited by federal debt collection law.
