Afni, Inc. is facing a proposed class action lawsuit from a Wisconsin consumer who claims the defendant violated federal debt collection law by hindering her from disputing the debt and failing to clearly identify her creditor.
Afni, Inc. is facing a proposed class action lawsuit from a Wisconsin consumer who claims the debt collector violated provisions of the Fair Debt Collection Practices Act (FDCPA). The plaintiff says she received a collection letter from the defendant that contained a settlement offer and a date by which her payment needed to be received. The suit argues that the deadline was set near the end of the 30-day validation period during which the plaintiff could request verification of or dispute the debt, forcing her to choose between accepting the potentially one-time offer or exercising her validation rights.
The case further alleges the letter failed to clearly identify the plaintiff’s creditor because it claimed the debt was owed to AT&T Mobility but also referenced AT&T.
