From Wisconsin comes a proposed class action against Capital One Bank (USA), N.A. alleging it violated the federal Telephone Consumer Protection Act (TCPA) by placing calls to consumers’ cell phones without permission. The plaintiff argues the bank used prohibited automatic telephone dialing equipment to place the calls, which also allegedly violated the Wisconsin Consumer Act.
According to the plaintiff, the unauthorized robocalls stemmed from missed payments on accounts she had with the defendant. Although she revoked consent for the bank to contact her by phone via two letters, Capital One, despite acknowledging receipt of the letters, went on to place several more calls to the plaintiff’s cell phone and work phone via autodialer, the suit claims.
