Portelli v. Western Window Systems, LLC et al.
Filed: November 21, 2017 ◆§ 3:17-cv-02367-DMS-BLM
Western Window Systems, LLC and WWS Acquisition, LL have been accused of manufacturing and selling folding glass doors and windows that leak and cause damage to buildings in which they’re installed.
Western Window Systems, LLC and WWS Acquisition, LLC (which does business as Western Window Systems) have been accused of manufacturing and selling folding glass doors and windows that leak and cause damage to buildings in which they’re installed. The plaintiff in the case says he purchased windows and doors from the defendants for his home based on Western Window’s claims that the products would be long-lasting and low-maintenance. He found, however, that they contained an alleged defect that allowed water to seep into the other components of his home, the suit says.
According to the complaint, the plaintiff informed the defendants of the problem on three separate occasions and was told that issue was a result of faulty installation rather than a manufacturing defect in the windows and doors themselves. The man claims he then hired a fenestration expert who inspected his home and concluded that the damage was instead caused by Western’s “defective design and manufacture.” The complaint argues that the defendants failed to warn consumers of the alleged defect and are liable for the cost of replacing the defective products and repairing any water damage.
The suit seeks to cover a proposed class of individuals who purchased Western’s Series 600 and Series 670 windows and Series 600 sliding glass doors within the past four years.
