The 51-page lawsuit says that though the Nebraska-based company first discovered on December 1 that its network had been hacked, a subsequent investigation showed that the unauthorized activity had been “consistent” since November 25. The suit relays that in March 2023, the investigation finally determined that the data compromised in the breach included, without limitation, current or former employees’ names, dates of birth, Social Security numbers, driver’s license or state ID numbers, medical information, health insurance details, passport numbers and/or financial account information.
Although the defendant “had the resources necessary to prevent the [data breach],” the company nonetheless failed to sufficiently “invest” in cybersecurity and adequately monitor its computer systems, the case claims.
According to the complaint, West Technology Group began sending notices to victims of the breach in mid-April of this year. However, the filing shares, the notices failed to explain why it took so long for the company to detect the hack, why the investigation lasted for three months or why West Technology Group delayed again before notifying impacted individuals.
Employees reasonably trusted the defendant—a “sophisticated company directly plugged into the data and information sector”—to uphold its legal obligation to protect their sensitive information from unauthorized disclosure, the lawsuit contends.
The plaintiff, a Texas resident who worked for West Technology Group as a claims adjuster between February 2018 and June 2020, received notice on April 17 of this year that her private data had been compromised in the breach, the suit says.
Since the incident, the case describes, the plaintiff has noticed a “notable influx of spam calls, texts, and emails, some of which contain attempts to phish additional information from [the woman], and some of which contain disgusting and disturbing content and unsolicited advertisements.”
The lawsuit looks to represent anyone in the United States whose personal information was compromised during the data breach about which West Technology Group sent notices on or around April 17, 2023.
