A proposed class action filed against Weltman, Weinberg & Reis Co., LPA claims the Ohio agency violated the Fair Debt Collection Practices Act (FDCPA) in some communications with consumers. The lawsuit, filed in New York, claims the defendant sent the plaintiff a collection notice that, when viewed from the perspective of the “least sophisticated consumer,” may be confusing or misleading. Specifically, the defendant allegedly sent a collection notice in which it failed to accurately convey the amount of debt owed since, the plaintiff claims, it failed to note whether the debt may increase due to accruing interest and/or fees.
