Loveland v. Weltman Weinberg & Reis Co LPA
Filed: July 13, 2017 ◆§ 2:17-cv-00961-WED
Weltman, Weinberg & Reis Co. is facing allegations the law firm unlawfully sent out 'confusing and misleading' debt collection notices.
Wisconsin
Weltman, Weinberg & Reis Co., LPA is the defendant in a proposed class action out of Wisconsin alleging the law firm violated the Fair Debt Collection Practices Act (FDCPA) while attempting to collect consumer debts. The plaintiff claims he received a notice from the defendant that was wholly “confusing and misleading” because it falsely implied an attorney was meaningfully involved in collecting his debt. An unsophisticated consumer such as the plaintiff, the lawsuit argues, would incorrectly believe upon receiving the defendant’s collection notice that an attorney “is personally and professionally involved in the consumer’s file.” This tactic is often described in debt collection class actions as one used by collectors to intimidate or impart a false sense of urgency upon debtors.
