Welk Resort Group, Inc. and Soleil Communications, Inc. are facing a proposed class action that claims the parties placed auto-dialed telemarketing calls to consumers’ cell phones without obtaining prior consent to do so.

Welk Resort Group, Inc. and Soleil Communications, Inc. are facing a proposed class action that claims the parties violated the Telephone Consumer Protection Act by placing auto-dialed telemarketing calls to consumers’ cell phones without obtaining prior consent to do so. The plaintiff says he never provided the defendants with his cell phone number, yet received a call from them in September 2017 attempting to convince him to attend a timeshare sales presentation. The suit argues that the defendants unlawfully failed to check the National Do Not Call Registry and delete from their calling lists “protected numbers” like the plaintiff’s.
