Walmart Inc. finds itself as the defendant in a lawsuit that alleges the company sent an unsolicited fax advertisement to an addiction treatment center.
Walmart Inc. finds itself as the defendant in a proposed class action that alleges the company sent an unsolicited fax advertisement to a Louisville, Kentucky addiction treatment center.
According to the case, Walmart Pharmacy sent the plaintiff in August 2016 an unlawful fax in which it promoted its immunization services. The plaintiff claims it had no prior relationship with the pharmacy nor authorized the company to send any advertisements. Further, the suit alleges the fax did not contain a proper opt out notice, which is required under the Telephone Consumer Protection Act (TCPA).
