Volkswagen is on the receiving end of a proposed class action claiming the embattled German car maker deceived consumers by installing 'defeat device' software.
Volkswagen is on the receiving end of a proposed class action claiming the embattled German car maker deceived consumers by installing a “defeat device” software algorithm in certain vehicles to cheat emissions tests. According to the complaint, the Environmental Protection Agency was duped into approving non-compliant diesel engine cars for sale that fell in line with emissions requirements during testing, but actually produced higher levels of carbon dioxide during normal use. The complaint notes that, in addition to consumers and regulators, Volkswagen sales staff have also bore the brunt of the company’s devious practices.
“As a result of this scheme, consumers across the nation came to associate the Volkswagen brand with defective vehicles and fraudulent conduct, and sales persons across the nation experienced a sudden drop in customer inquiries, potential sales, and—ultimately—personal income,” the complaint says.
