The 10-page Vivid Seats class action lawsuit says that under New York’s Arts and Cultural Affairs Law, a “place of entertainment” must disclose the total cost of a ticket, including fees, in the ticket listing before it is selected for purchase. The state law, which came into effect in August 2022, mandates that ticket prices “shall not increase during the purchase process,” the filing relays.
According to the complaint, the ticket resale company has violated New York law by failing to include the cost of fees in the total ticket prices initially advertised on VividSeats.com.
The lawsuit points out that when a consumer visits Vivid Seats’ website to purchase, for example, a ticket to a New York Mets baseball game at Citi Field, they’re presented with several seat options set at varying prices.
“Regardless of which ticket the customer selects, the purchase price that customer is offered is misleading as it is not the total cost of the ticket, inclusive of all fees,” the case shares.
The suit says that only after a consumer selects a seat does the company reveal a fee that increases the total ticket price. For instance, a ticket initially advertised as $80 increases to $109.10 upon being chosen thanks to a hidden $29.10 fee, the complaint contends.
The lawsuit looks to represent anyone in the United States who purchased tickets online from VividSeats.com to any New York-based place of entertainment on or after August 29, 2022.
