The 13-page lawsuit was filed by an Arizona resident who says he received a text message from Vivek 2024—a campaign committee endorsing 2024 U.S. presidential candidate Vivek Ramaswamy—on August 23 of this year despite having never provided the committee his cell phone number nor his consent to be contacted.
According to the case, the text included a video file that automatically downloaded to the plaintiff’s phone and delivered a message using an artificial or prerecorded voice.
The complaint contends that Vivek 2024 is prohibited under the federal Telephone Consumer Protection Act from using an artificial or recorded voice to deliver non-emergency text messages without first receiving the recipient’s express consent.
As part of its “intrusive” campaign to promote its political agenda, Vivek 2024 sent these texts “en masse without variation” to individuals who have had “no prior contact, dealings, or relationship” with the campaign committee, the filing alleges.
The plaintiff says the spam text was an “invasion of his privacy” and a “disruption to his daily life,” causing him “aggravation” and “annoyance.”
The lawsuit looks to cover anyone in the United States who, within the past four years, received a text call via MMS from the Vivek 2024 campaign committee or anyone on its behalf that included an audible artificial or prerecorded voice to deliver a message without their prior express consent.
