Vital Recovery Services, Inc. is facing a New York man’s proposed class action lawsuit that claims it violated the Fair Debt Collection Practices Act by leaving a voicemail at the plaintiff’s place of employment.
Vital Recovery Services, Inc. is facing a New York man’s proposed class action lawsuit that claims it violated the Fair Debt Collection Practices Act by leaving a voicemail at the plaintiff’s place of employment. According to the complaint, the defendant called the man’s office telephone number and, in a message left on his answering machine, identified itself as a debt collector. The plaintiff claims he suffered “embarrassment and humiliation” after his assistant listened to the message and argues that he never provided the defendant consent to communicate with a third party regarding his alleged debt.
