Vital Recovery Services, LLC is facing a proposed class action lawsuit claiming it failed to inform a consumer that the statute of limitations on her debt had expired, in alleged violation of the Fair Debt Collection Practices Act.
Vital Recovery Services, LLC is facing a proposed class action lawsuit claiming it failed to inform a consumer that the statute of limitations on her debt had expired, in alleged violation of the Fair Debt Collection Practices Act (FDCPA). The plaintiff says she received a collection letter from the defendant dated March 24, 2017 that indicated her last payment was submitted on December 20, 2011. According to the suit, the defendant misrepresented the legal status of the plaintiff’s debt by failing to disclose that the statute of limitations had “lapsed” and omitted information about any potential consequences of not paying.
