Victoria’s Secret Settlement Resolves Missouri Sales Tax Class Action Lawsuit

A proposed class action claims Victoria’s Secret has overcharged for sales tax on purchases delivered to Missouri addresses from an out-of-state facility.

A settlement has been reached to resolve a proposed class action lawsuit that alleged Victoria’s Secret overcharged Missouri consumers on sales tax for certain purchases shipped from out-of-state.

The court-approved website for the class action settlement can be found at MOTaxSettlementVictoriasSecret.com.
The deal covers all individuals who, between May 18, 2016 and May 18, 2023, bought at least one personal, physical retail product from either VictoriasSecret.com or another remote sales channel for which Victoria’s Secret was responsible for calculating the tax due on the purchase. Qualifying purchases specifically include those shipped by or for Victoria’s Secret from a location outside of Missouri to a delivery address located within Missouri, where the customer was charged a higher tax rate than the vendor’s use tax rate.
Class members do not have to do anything to receive a Victoria’s Secret settlement payout.
According to the settlement website, covered individuals will automatically receive a pro-rated payment based on the total amount charged for their qualifying purchases, the number of class members eligible for a refund and the total settlement funds available.
“If you received a full refund on your qualifying purchase, you are not included,” the site says. “However, if you received a partial refund, you will be eligible to receive an additional refund.”

Class members who do not complete a payment method selection form will have their automatic payment sent to the email used to make a qualifying purchase, provided Victoria’s Secret has that email on file. The settlement website notes that if a class member does not have a PayPal account for their email address, they can set one up through PayPal.com.
The deal with Victoria’s Secret was preliminarily approved by the court on February 3, 2025. It is now up to the court to decide whether to grant final approval to the terms of the deal at a hearing set for June 2, 2025. Class members will get their payments after the deal receives final approval and any appeals are resolved.
The initial complaint against Victoria’s Secret was filed by a Missouri consumer who claimed he was charged an 8.74 percent sales tax for items he bought from the retailer’s website in 2021 that shipped from out of state. However, the lawsuit alleged, the applicable sales tax for such a purchase was only 4.225 percent.
