The class action settlement covers anyone who was impacted by the Vi data breach, which reportedly occurred between March 10 and March 13, 2023. According to the Vi Living lawsuit, unauthorized access to the luxury senior living center’s computer systems compromised confidential information such as names, addresses, dates of birth, Social Security numbers, financial account and payment card numbers, medical treatment details and other health-related data.
Only class members who submit a valid claim form online or by mail by the February 3, 2025 deadline will be eligible to receive Vi settlement benefits.
To file a settlement claim form online, head to this page. You will need your unique claim login ID and PIN, which can be found on the personalized settlement notice you received in the mail.
Alternatively, you may download the PDF claim form or contact the settlement administrator to request a paper copy to return by mail.
Per the Vi settlement website, class members can submit a claim for reimbursement of “ordinary” losses that were incurred as a result of the hacking incident and are supported by documentation, for up to $1,500 per person.
In addition, consumers can submit a claim for reimbursement of documented “extraordinary” expenses that occurred between March 13, 2023 and February 3, 2025 and are reasonably linked to the data breach, for up to $5,000 per person, the site shares.
The website says that class members may also file a claim form for up to three hours of lost time spent responding to issues raised by the incident, at a rate of $25 per hour. Per the site, consumers who provide supporting documentation can claim an additional four hours of lost time, for a total of seven hours.
On top of the aforementioned cash payouts, class members may submit a claim for two years of identity theft protection and medical data monitoring at no cost, the website adds.
Finally, Vi Living has also agreed to take certain measures to improve its cybersecurity and better secure its systems, the site says.
The Vi Living settlement was preliminarily approved by the court on September 20, 2024. Next, the court will determine whether to grant final approval to the terms of the deal at a hearing set for February 19, 2025.
According to the website, Vi settlement payouts will be issued to eligible class members only if the deal is ultimately approved, and after any appeals are resolved.
