Poag Shopping Centers, LLC, which does business as The Shops at Valley Square in Warrington, Pennsylvania, is the defendant in a proposed class action filed over alleged violations of Title III of the Americans with Disabilities Act (ADA). Described in the complaint as a 42-year-old with osteogenesis imperfecta who relies on a wheelchair for mobility, the plaintiff claims she experienced “difficulty and unnecessary risk” in parking her modified mini-van at the defendant’s facilities because none of the roughly 840 parking spaces were marked “van accessible.” Specifically, the case claims, the purportedly van-accessible parking spots are not wide enough and do not have an appropriate access aisle in which the plaintiff can utilize her van’s side-ramp modification.
“The pervasive nature of [the defendant’s] ADA non-compliance at ‘The shops at Valley Square’ is blatant and visible to the ‘naked eye’,” the complaint alleges.
