Valentine & Kebartas, LLC is the defendant in a proposed class action lawsuit that claims it sent a misleading collection letter to a New York consumer. According to the suit, the letter set forth a balance and demanded payment, but made no mention of the consumer’s right to dispute or validate the debt, an alleged violation of the Fair Debt Collection Practices Act (FDCPA). “The least sophisticated consumer,” the complaint explains, “would assume from the said letter, that he has no option to dispute his debt or obtain verification of the debt.”
