Another proposed class action against—you guessed it—Samsung and its electronics division, claims it sold defective washing machines.
Another proposed class action against—you guessed it—Samsung and its electronics division, as well as Home Depot, Lowe’s Best Buy and Sears, claims the companies should be held responsible for marketing and selling defective washing machines with a propensity to explode during normal usage.
This latest case, filed in Kentucky, argues the defendants’ handling of the consumer headaches caused by the allegedly defective washers was inadequate for the plaintiff and proposed class members because the make-good options and deadline dates presented by the companies just didn’t cut it.
“None of the options were available to [the plaintiff] because: (1) the retrofit that Samsung proposes does not actually fix the machine so that [the plaintiff] can use it as intended at sale; (2) the rebate is a fraction of the cost of replacement; and (3) [proposed class members] purchased their machines before the recall,” the lawsuit contends.
The lawsuit seeks relief for proposed class members through an injunction against the defendants preventing any further sale of the problematic washers and reasonable monetary damages to compensate individuals who own the recalled machines.
