‘Unusable’: Google Pixel Pro 6 Lawsuit Claims ‘Defective’ Smartphones Prone to Overheating

The 22-page case accuses Google of falsely advertising the Pixel Pro 6 as “a functional working phone” when the apparent defect renders the device “functionally useless and unreliable” given that overheating can inhibit the phone’s basic functions.
According to the proposed class action lawsuit, Google is “well aware” of the Pixel Pro 6 overheating issue yet to date has not recalled the devices or initiated a campaign to inform consumers of the defect.
The plaintiff, a Glendale, California consumer, purchased a Google Pixel Pro 6 from a Verizon Wireless store for nearly $900 in December 2021, the suit says. The consumer chose that model smartphone over similar devices “because the Products were advertised as being normal, useable phones,” supposedly the “smartest, fastest, and most secure Pixel phones,” the lawsuit shares.
Immediately after buying the Pixel Pro 6, however, the plaintiff was “shocked to discover” that the device was prone to overheating, often to the point where the woman would be unable to hold it in her hands, the complaint claims.
“Due to the Defect, the Product would begin to shut down features or simply stop working altogether,” the case says.
Though the plaintiff requested a replacement Pixel Pro 6, replacement models suffered from the same overheating problem, according to the suit.
“Over the next several months, Plaintiff requested numerous replacement phones from Verizon, each phone was always the same model; a Google Pixel 6 Pro phone. All of which had the same overheating Defect, which would render the phone virtually unusable after minimal use.”
Per the case, the plaintiff has been harmed financially as she has not received the product for which she bargained.
“[Google] has falsely represented that their Class Products are able to perform and function as normal phones, and of superior quality to other models of smartphone,” the lawsuit alleges.
The case looks to cover all consumers in California who bought one or more Google Pixel Pro 6 smartphones within the last four years and through the date of class certification.
