Universal Fidelity LP finds itself as the defendant in a proposed class action in which the plaintiff claims the company failed to explicitly identify the creditor to whom his debt is owed. The focus of the suit is a January 2018 collection notice in which the defendant allegedly stated “RE: Bradford Authenticated” without explicitly indicating whether this entity is the plaintiff’s current creditor, the creditor to whom payment should be submitted, or the plaintiff’s original creditor.
Moreover, the lawsuit takes issue with the statement in the notice that “The debt that you owe to the above-referenced client has been placed with Universal Fidelity LP.” The notice, the case says, failed to note who the “above-referenced client” is or provide any indication as to who referred the plaintiff’s account to the defendant.
