United Recovery Systems LP is the defendant in a proposed class action that claims the debt collector failed to clearly state the full amount of consumers’ alleged debts. According to the complaint, the collection notice sent to the plaintiff stated a “Current Amount Due” without specifying the date it was calculated, if the balance would increase due to interest or legal fees, or if the defendant intended to waive any interest. The plaintiff says he was unsure how to pay off the full balance of his alleged debt because it could have increased by the time he made a payment. The suit argues that the “Defendant's communications were designed to cause debtors to suffer a harmful disadvantage in charting a course of action in response to the Defendant's collection efforts.” It further claims that United Recovery’s “unfair and abusive practices” were part of “a scheme or business” it used when attempting to collect consumers’ debts, and that these systematic actions violate the Fair Debt Collection Practices Act.
