The deal with United of Omaha will provide all class members who submit a timely, valid claim form with two years of identity theft protection and credit monitoring services. This benefit is in addition to any such services that may have been offered previously to individuals who were notified about the data breach, the site says.
Class members may also file a claim for up to $1,500 per person in compensation for documented out-of-pocket losses that stemmed from the incident and have not already been reimbursed. Per the site, qualifying expenses may include fees related to credit reports, credit monitoring services or identity theft insurance; phone or data charges; postage; gas; bank fees; and other miscellaneous costs.
Additionally, consumers are eligible to receive reimbursement for up to four hours of lost time spent dealing with the data breach, at a rate of $20 per hour, subject to the $1,500 cap, the website states.
Alternatively, class members can choose to forego the aforementioned monetary benefits in lieu of a $50 cash payout.
The court will determine whether to grant final approval to the terms of the United of Omaha class action settlement at a hearing on June 25, 2025. United of Omaha settlement rebates will be issued to eligible class members only if the deal receives ultimate approval, and after any appeals are resolved.
The United of Omaha lawsuit claimed negligent cybersecurity on the insurer’s part was to blame for the incident, which the company discovered in late June 2024. The data breach suit contended that the cyberattack may have compromised confidential personal information, including full names, dates of birth, addresses, Social Security numbers, driver’s license numbers, employment data, health insurance policy numbers and certain medical information.
