A New York woman has filed a proposed class action lawsuit against United Collection Bureau, Inc. claiming the defendant sent her a deceptive collection letter.
A New York woman has filed a proposed class action lawsuit against United Collection Bureau, Inc. claiming the defendant sent her a deceptive collection letter. According to the suit, the letter informed the plaintiff that if she accepted a settlement offer for less than the full balance of her debt, her creditor might present her with “less favorable terms” for future services. The complaint claims this statement falsely implies the converse – that if the plaintiff pays her full balance, she will be presented with greater credit opportunities and improve her credit score.
Additionally, the letter allegedly included a settlement offer that was marked with a deadline of July 28, 2017, which the suit notes was only 11 days after the date the letter was sent. The case claims the defendant’s deadline was “false and misleading” and that the creditor authorized the debt collector to accept a settlement at any time.
