The 11-page Uber lawsuit contends that the company has run afoul of a Florida law that prohibits sales tax from being charged on a delivery fee that the consumer has the option of avoiding by opting for pick-up rather than delivery.
The plaintiff, a Florida resident, ordered food using Uber’s platform in May and June 2024, the suit shares. According to the case, the woman selected to have her order delivered and was allegedly charged by Uber unlawful sales tax on the respective $3.99 and $2.49 delivery fees.
The complaint claims that Uber has illegally assessed “thousands of dollars, if not more,” in sales taxes on avoidable delivery fees charged to Florida consumers, in knowing violation of state law.
The Uber sales tax lawsuit looks to represent anyone in Florida who, in the past four years, was charged by the company and paid sales tax on a delivery fee that was separately stated on an invoice or receipt when there was an option to pick up the order at one of Uber’s Florida locations.
