GC Services Limited Partnership is on the receiving end of a proposed class action filed by two named plaintiffs who allege the debt collector failed to clearly state their debt amounts.
The first plaintiff says he received a collection letter from the defendant specifying a “new balance” of $2,445.76 on his charged-off Best Buy credit card account. Also included in the letter, the case continues, was language indicating that the man’s balance “may be greater” on the day he pays due to added “interest, late charges, and other charges that may vary from day to day.” The lawsuit argues that because the plaintiff’s account was charged off, neither the defendant nor the man’s creditor intended to add additional interest or other charges. The letter was therefore misleading and deceptive, the suit claims, in that it falsely implied the plaintiff’s account was increasing.
The second plaintiff says she received a collection letter from the defendant on May 2, 2018, regarding her QCV credit card account that stated a “balance due” of $44.31. A few days earlier, however, the defendant had sent the plaintiff a collection letter indicating her “amount past due” was $29.54, the complaint notes. The case claims the plaintiff, upon reading the letters, was unsure as to how much she truly owed.
